Terms of use
This is a translation. In case of any differences, the German version prevails.
1. Provider and scope
Lossboard is provided by Johannes Müller, Simone-Veil-Straße 30, 53121 Bonn, Germany, email: [email protected] ("we", "us").
These terms apply to the use of the Lossboard app for iPhone and Android, the website lossboard.app and taking part in the browser. By joining or creating a challenge you accept these terms and the privacy policy. This includes your consent to the processing the challenge requires (privacy policy, section 5). There are no separate checkboxes or confirmations. How we handle your data is explained in the privacy policy.
2. What Lossboard is
Lossboard is an app for challenges in closed groups of 2 to 30 people, for example among friends, family or colleagues. One person creates a challenge and invites the others by link or code. Members enter their weight once a week. A leaderboard shows the change in percent according to fixed rules, with a cap for a steady pace. We explain the scoring rules on the help page.
Sharing within the group is part of using Lossboard: the members of a challenge see your nickname and your score, and members can share images of the leaderboard or the result as described in the privacy policy (section 5.5).
Lossboard is a leisure and motivation service. It is not a medical device and not a health service.
There are no public challenges. Lossboard shows no ads and sells no third-party products.
3. Minimum age and self-declaration
Lossboard is only for people aged 18 and over. By creating or joining a challenge you declare that you are at least 18 years old.
By doing so you also declare that none of the following applies to you:
- You are pregnant or breastfeeding.
- You have or have had an eating disorder.
- A doctor has advised you against losing weight.
If any of these applies, please do not take part. We do not ask about your age or these points separately and store no details about them. You are responsible for the accuracy of your declaration.
If we learn that a person under 18 is taking part, we remove them from all challenges and delete their data.
4. No medical advice
Lossboard does not give medical advice, does not make diagnoses and does not replace advice from a doctor. The scoring, the cap and all texts in the app are only meant as guidance within the group.
Please talk to a doctor before you aim to change your weight significantly, especially if you have existing conditions or take medication. If you feel unwell or notice that the challenge is weighing on you, stop and get support. Support services by country are in the app under "Me → Support" and on the help page.
You are responsible for your health and for how you change your weight.
5. Taking part without an account
You do not need an account. Your participation is tied to your device. Under "Me" you will find a recovery code that lets you move your participation to a new device. Keep it safe and do not share it. Without this code we cannot restore a lost participation, because we have no other way to recognise you.
6. Rules for all members
You agree:
- to only enter weights you have actually measured,
- not to use a nickname or agreement text that insults, exposes, threatens, discriminates against or sexually harasses others, and not to infringe the rights of third parties,
- to only photograph the scale display, without your body, without other people and without personal items that make you or others identifiable,
- to only share other members' data, nicknames and values in the ways the app provides,
- not to pressure other members to lose weight at an unhealthy pace,
- not to disrupt the app technically, not to query it automatically and not to use other people's access.
7. The agreement
The organizer can optionally enter an agreement as free text, for example "The winner picks the restaurant" or "The last two cook at the final dinner".
- The agreement is a voluntary arrangement among the members. We are not a party to the agreement and have no influence on whether it is kept.
- No money flows through the app. Lossboard does not collect, hold or transfer members' money, does not calculate anything and does not show who owes whom.
- The price of a challenge is the same with or without an agreement. The purchase unlocks the challenge for the group. It has nothing to do with the agreement.
- Under Section 762 of the German Civil Code (BGB), agreements of this kind create no legally enforceable obligation. Agreements in Lossboard are therefore not legally enforceable.
- Betting with money through Lossboard is prohibited where it is unlawful under the law that applies to those involved. The app does not provide for agreements involving amounts of money.
- We may switch off the agreement for all or individual challenges at any time, or hide individual agreements that breach these terms.
8. Reporting and moderation
You can report nicknames, agreements and scale photos in the app. Reported content is hidden from the group immediately. We usually review reports within 48 hours. For nicknames and agreements we also use an automatic word filter.
If content breaches these terms or applicable law, we may delete it, remove the member from the challenge or, in serious cases, exclude them from using Lossboard. We decide based on the circumstances of the individual case and take the interests of everyone involved into account. The person affected can ask us by email to review the decision again.
You can also report content to us by email at [email protected].
9. Organizer rights and duties
The organizer:
- sets the name, start, duration (4 to 16 weeks), weigh-in day, visibility (percent only, or percent and kg), whether a scale photo is required, and the agreement,
- can change the dates until the start,
- can only reduce, not extend, the visibility once others have joined,
- can remove members, for example in case of breaches or implausible values,
- sees scale photos in photo challenges and the label "corrected" for corrected values,
- can end the challenge early,
- is responsible for only inviting people they know who are at least 18 years old.
If the organizer leaves, the role passes to the member who has been in the challenge the longest. A purchase stays with the challenge.
The organizer's rights end where they would interfere with the rights of other members. The organizer must not pass on other members' values or photos outside the app.
10. Prices and purchases
10.1 What it costs
| Package | People | Price | Type |
|---|---|---|---|
| Free | up to 3 (including the organizer) | EUR 0 | |
| Challenge | up to 10 | EUR 4.99 | one-time, no subscription |
| Large challenge | up to 30 | EUR 9.99 | one-time, no subscription |
| Upgrade from 10 to 30 | up to 30 | the difference, currently EUR 5.00 | one-time |
| Organizer year | any number of challenges with up to 30 people each, 12 months | EUR 19.99 | one-time, does not renew |
These prices apply in Germany and include statutory VAT. In other countries the App Store or Google Play shows the local price. The price shown to you before purchase always applies.
- Only the organizer pays. All other members never pay.
- A purchase applies to one challenge and the whole group. A "New round" is a new challenge.
- All features are the same in all packages, including the free version.
- Organizer year: valid for 12 months from purchase for all challenges the holder starts during that time. A challenge that starts within the 12 months runs until its end. The pass does not renew automatically. There is nothing to cancel, it simply ends.
10.2 Purchase before the start, no lock after the start
- Members can join before the purchase. For more than 3 people the purchase must be made before the start. If it is not made, the challenge starts with the first 3 people or is postponed.
- We never lock a challenge after it has started, not even after a refund, a change of device or the end of an organizer year. The challenge runs until its end.
- There are no upsells, no pop-ups and no features that would need to be unlocked in the middle of a challenge.
Current status: the purchase options in 10.3 and 10.4 are prepared. As long as they are not switched on, no real purchase can be completed.
10.3 In-app purchase (prepared)
This section applies once in-app purchases are switched on.
In the app you buy through Apple's App Store or Google Play. The payment is made under Apple's or Google's terms, and Apple or Google process it. You request refunds directly from Apple (reportaproblem.apple.com) or Google Play. We cannot refund store purchases ourselves.
10.4 Web purchase (prepared)
This section applies once purchases on the website are switched on.
On the website you buy directly from us. Stripe processes the payment. The contract is concluded when you click "Order with obligation to pay" and the payment is confirmed. You receive a confirmation by email. You have a right of withdrawal for web purchases, and we voluntarily refund the full price within 14 days. Details are in the withdrawal policy.
A web purchase and an in-app purchase have the same result: the challenge is unlocked for the group, whatever device the members use.
11. Availability and changes to the app
We try to provide Lossboard without interruption but cannot guarantee it, for example during maintenance or outages at service providers. We keep developing the app. We do not restrict features you have paid for in a running or already paid challenge.
If we ever shut Lossboard down, we will announce it in the app at least 60 days in advance. We will let running paid challenges run until their end or refund the price on a pro rata basis.
12. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
For slight negligence we are only liable if we breach an essential contractual obligation, meaning an obligation whose fulfilment makes the use of Lossboard possible in the first place and on whose fulfilment you may rely. In that case liability is limited to the foreseeable, typical damage.
We are not liable for agreements between members or whether they are kept, because we are not involved in them. Members are responsible for the content they post.
If you live outside the EU, nothing in these terms excludes or limits rights you have under mandatory consumer law where you live.
13. Leaving, deletion and exclusion
- You can leave a challenge at any time. Your weight data is then deleted immediately.
- Under "Me → Data" you can delete all your data. This ends the user agreement.
- We may remove members from a challenge or exclude them from using Lossboard if they seriously or repeatedly breach these terms, in particular sections 3, 6 or 7. Where reasonable, we warn them first. If the organizer themself committed the breach, prices already paid for a challenge are not refunded after a justified exclusion.
14. Additional terms for the iPhone app
If you download Lossboard from Apple's App Store, the following also applies:
- These terms are between you and us only, not with Apple. We alone, not Apple, are responsible for Lossboard and its content.
- You may use the app on Apple devices that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claims relating to the app, for example product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection or privacy law.
- If a third party claims that the app infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a US Government embargo and that you are not listed on any US Government list of prohibited or restricted parties.
- Questions and complaints about the app should be sent to us (section 1).
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. Changes to these terms
We may change these terms if the app, the law or app store requirements change. We will inform you in the app at least 30 days in advance. If you do not object within that period and keep using Lossboard, the new terms apply. We point out the period and its consequences in the notice. We do not change prices or features for challenges that are already paid for.
16. Law, language and dispute resolution
German law applies. If you are a consumer and habitually reside in another country, the mandatory consumer protection provisions of that country remain unaffected.
These terms are available in German and English. In case of any differences, the German version prevails.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have a question or a problem, simply email us at [email protected].
If any provision is invalid, the remaining provisions remain valid.
